At TPN, we are steadfast in our commitment to keeping you informed and compliant.
A recent compliance notice was issued to registered Information Officers and Deputy Information Officers by the Information Regulator in terms of the Promotion of Access to Information Act (PAIA), titled "Compliance notice in terms of section 83(3)(d) of the Promotion of Access to Information Act 2 of 2000".
This compliance notice mandates that all private and public companies must upload Form 2 and Form 3 to their respective websites.
- Form 2 is the ‘Request for Access to Record Form’ which clients can complete to obtain access to all the personal information of that particular person that is held by your company.
- Form 3 is the ‘Outcome of Request and of Fees Payable Form’ which you will be required to complete upon the conclusion of any Request for Access to Record.
The forms need to be available on your website as separate download links, even if they already form part of your PAIA Manual. There is no obligation to submit the forms to TPN or the Information Regulator but rather an obligation to simply download these forms and load them on your website for any clients to have access to lodge a Request for Access to Record.
TPN POPI-Portal Subscribers can follow the below process:
- The required PAIA forms (Form 2 and Form 3) have been uploaded onto the portal here where you are able to download the required forms (if you have issues logging into your POPI-Portal or to determine if you are subscribed to our POPI-Portal, please contact our Helpdesk on 0861 876 000).
- Once the forms have been downloaded, you are entitled to rebrand or edit the forms as necessary.
- The forms, whether edited by yourselves or not, can then be loaded onto your own website for access by any person wishing to access these forms from your organisation (please contact your IT department for assistance in the loading of the form onto your website).
Non TPN POPI-Portal Subscribers can follow the below process:
- Download the forms as editable PDFs from the Information Regulator's website here.
- The forms, whether edited by yourselves or not, can then be loaded onto your own website for access by any person wishing to access these forms from your organisation (please contact your IT department for assistance in the loading of the form onto your website).
